If dish network can't provide the service how can they charge a cancellation fee?

do not understand what you are saying. in order for a cancellation fee to take place, two thing had to happen. first your service was activated. If you have no line of sight, this should never of happened. second, you had to sign a contract. why would you do that if you could not get service?
